klaklak.com is run by Hertge VOF, a general partnership under Dutch law, President Kennedylaan 154, 2343 GV Oegstgeest, the Netherlands. Chamber of Commerce number 88251918, VAT number NL864554187B01. You can reach us at info@hertge.com. These terms are governed by Dutch law.
Anyone can open a free chat room by putting a name after klaklak.com. It needs no account. A free room is not owned by anybody: the name is not reserved, anyone with the link can join, and the room clears itself after a day with nobody in it. The service is provided "as is", without warranty. We may change or discontinue it at any time.
klaklak has had invite-only rooms: a room on its own address where only the people on a guest list could enter. They are not being offered at the moment. Nothing has been thrown away and they may come back; if you had one, write to info@hertge.com and we will tell you where your room and its guest list stand.
We sell a single line of sponsored text under the message box of the free rooms, by the
month. What that costs and what we do not accept is on our
advertising page. An advertising agreement is made by e-mail and
invoiced by Hertge VOF. Sponsored links carry rel="nofollow sponsored". We can
refuse or end an advertisement at any time if it turns out to mislead people, and then we
refund the unused part of the month.
There is nothing on this site you can buy with a card, so there is no checkout to undo. Two things do involve money, and this is where each one stands.
Advertising is agreed by e-mail and invoiced in advance by the month. Nothing renews by itself, so there is nothing to cancel: a period ends unless you ask for another one. If your line was not shown as agreed and we could not put it right, you get the unused part of the month back. Write to info@hertge.com and you will have an answer within a few working days.
Support payments through our support page are a gift. Nothing is bought, nothing is unlocked and nothing is owed in return, so there is nothing to refund. If you sent one by mistake or for the wrong amount, say so and we will pay it back.
You may not use the chat for unlawful purposes or to share: illegal content, threats, harassment or hate speech, spam, malware, copyright infringement, or material that harms minors. Violations may result in message removal, removal from the chat (kick/ban) and - where applicable - reporting to the relevant authorities. We may end a paid plan for serious or repeated violations; in that case we refund the unused part of the period.
The creator of a room acts as moderator and can delete messages and remove participants. The owner of an invite-only room decides who is on the guest list and can take someone off it at any time, which takes effect immediately. An automatic word filter and a rate limit against spam also apply. The operator can read messages in order to deal with abuse reports; our privacy statement explains exactly when and for how long.

klaklak is a chat service, not a storage service or a backup. We do our best to keep it running but cannot guarantee it is always available or that messages are never lost. Our liability is limited to the amount you paid us in the twelve months before the problem arose. Nothing in these terms limits the rights you have as a consumer under Dutch law.
Most of klaklak is available in several languages. These terms are not: they exist only in English, and this English wording is the version that applies. If your browser offers to translate this page, that translation is there to help you read it. It is not a version of these terms and nothing in it can be relied on against the English above.
